As a potential employee do you know what all rights do have reserved for you at workplace? You will say, that must be taken care by the employer but this is not the situation. You must know about your rights and make sure that you get the full right as an employee. While applying for Employment / Work Visa all applicants should have this information as this is very helpful at times.
1. Overtime Pay: Working hour is decided by the UAE Govt. and as per the UAE Labor Law, if the work circumstances are in certain industries required more working hours to complete routine work than the normal schedule, in that situation extra hours are counted as overtime and every employer has to pay extra amount as routine work wages for extra hours.
2. Salary Deduction: There is no way the any employer can deduct any amount from your salary in the name unplanned, insufficient funds, or any reason which is not predefined. Your employer can simply deny your salary for destitute work result. It hardly counts what big mistake you did, you will surely loose your job but still you will get your salary without any deduction.
3. Delay In Payment Is Not Acceptable: There is a system developed wherein, you salary cheques gets sttucked after your pay period ends. Your employer needs to bear a penalty amount if he fails to do so. Secondly, if you are fired immediately then he has to pay your all dues and salary without any delay.
4. Working Off The Clock: If you are working for your employer in odd timings then also you are entitled to get paid for the work you do in that period for your employer, that cannot be exempted.
5. Salary Discussion Among Employees: This is true that your employer can restrict you from having a discussion about salary with your colleagues. However many employers have made policies that is against of this right but actually these policies breach the employee right law.
6. Working Condition At Workplace: You employer have no right to stop you from discussing working conditions at the work place with other colleagues like hygiene issue, back biting issues false humor issues. These all can be resolved once discussed frankly.
7. Safety At Work Place: If any condition that is no suitable, or not considered as ideal working condition wherein the employee feel danger for his/her health then they can deny to perform that task and inform this situation to their supervisor in writing or verbally in the presence of other colleagues. Labor law give protection to all employees in this condition, you can get back to work as soon as the incompatible conditions get fixed.
8. Identity Clearance For Contractor And Employee: There must be a clear identity between an employee and contractor. If your employer gives you clear insurrections about timings, location, and how to perform your routine tasks then as per law you are an employee and your company needs to pay you all benefits as regular employees. Only job tile does not make a difference in your work profile like Freelance Contractor.
9. Insurance For Being Unemployed: There are certain circumstances that make you eligible to get you insurance even if you are unemployed. If you got fired or resigned then you are eligible for unemployment insurance. Some of the reasons considered as good cause:
Personal reasons like marriage in family
Better opportunities in competitive market
Medical / Health reasons that does not allow you to perform you regular duties as required
Integrity issues like - Discrimination, Safety, Harassment, Hygiene, Demotions or cuts offs in salary.
