The revised version of the National Emission Standards for Hazardous Air Pollutants (NESHAP) requires an inspection for the presence of asbestos before renovation or demolition. If asbestos is discovered, the Environmental Protection Agency (EPA) must be notified by telephone. Disposal of material that contains asbestos must be made in an EPA-authorized facility. NESHAP has established Waste Shipment Records to track the movement of the waste from the time of the pickup until disposal. - A Waste Shipment Record (WSR) must accompany each shipment of waste that contains asbestos.
Each WSR requires the signatures of the waste generator, transporter and waste disposal site operator.
Keep copies of all WSRs for a minimum of two years. - A waste generator is any entity or individual whose activities produce waste that contains asbestos. Generators include manufacturers, asbestos mills, demolitions, renovators, fabricators and spraying operations.
If a copy of the WSR signed by the disposal site's representative is not received within 35 days of the shipment, attempt to find the answer. Contact the company that picked up the waste. If the delivery was delayed, get an explanation and the delivery date. If the delivery was made on time, contact the operator of the disposal site.
If the waste is not received within 45 days of the shipment, submit an exception report to the jurisdictional NESHAP agency. Enclose a copy of the WSR and a cover letter detailing your actions to rectify the situation. - When a waste shipment is received, send a signed copy to the generator.
If any discrepancies are found to exist between the amount of waste noted on the WSR and the quantity received, make a note of it on the WSR. If the matter remains unresolved after 15 days, file a report of discrepancy. Enclose a copy of the WSR and a letter describing the discrepancy and your attempts to settle the issue.
A written report must be submitted the following day if a large amount of improperly uncovered or enclosed waste is discovered when the shipment arrives. Describe the issue in detail and attach a copy of the WSR.
