- 1). Contact a lawyer. If you expect from the person you are filing against to fight your claim, a lawyer would be your best option. He can ensure that everything possible is done to make certain your filings are complete and accurate. Your child support information will be used to determine filing eligibility.
- 2). Contact the Greene County courthouse for a Child Abandonment Criminal Warrant Application. If you choose to hire a lawyer, he or she will get and fill out the form for you. There may be a small filing fee. If you are applying for the warrant without legal representation, your county's warrant office can walk you through the process.
- 3). Attend the set court date. In Georgia, this will be a criminal proceeding. A first or second offense when the defendant still lives in the state will be treated as a misdemeanor. However, if the defendant has left the state or has been convicted twice before, the charge will be considered a felony with a maximum sentence of three years in jail plus restitution for missed child support payments. In either case, the sentence may be suspended if the defendant agrees to pay all owed support and to make payments on time in the future.
