Wrongful Termination of Disabled Man in San Diego

Ian Rey, a 38-year-old former employee of Sprouts Farmers Market in Point Loma, and his family feel that his termination from the store was inappropriate. Rey worked at the market for 14 years and was let go after accidentally taking and then immediately returning a jacket from the break room.

Rey was born with Fetal Alcohol Syndrome and suffers from learning disabilities. He has lived away from his parents since he turned eighteen and has supported himself ever since. Customers at the store loved him and explained how he was always a good worker, very helpful and they were shocked at what happened to him.

Rey took a jacket from the break room, thinking that it was his own and left the store. His manager notified him of the issue, and he brought it back right away, exclaiming, €I feel upset.€ He was then put on suspension for three days before being terminated from his job.

When he returned the jacket, his manager told him to write an €I'm sorry€ letter, which Rey did. The manager then took the note to the corporate office as evidence of his admission to guilt for stealing.

Sunny Rey, Ian's younger sister feels that Sprouts fired her brother because of his disability. She believes that this wouldn't have been the outcome had someone else taken the jacket by mistake, and she is probably correct. Rey committed an honest mistake that was immediately rectified, but his employers used this as an excuse to get rid of him.

The market managers used to scare tactics with Rey in letting him go. They claimed that they had surveillance footage of the crime, but have refused to show it to him or his family. One has to agree with Sunny Rey that this termination is problematic and is filled with shadiness.

It is illegal to fire someone based on his/her disability as outlined in the Americans with Disabilities Act of 1990. A person's disability cannot affect hiring, job advancement, job training, worker's compensation or termination. Depending on how far the Reys would like to go with this problem, they have high chances of receiving damages from the market if they chose to file suit. Based on what has been provided so far in the situation, Rey has enough on his side to at least consider filing a claim.

Wrongful termination suits can be tricky and upsetting. Having an attorney on your side can be incredibly helpful in wading through all of the paperwork and in ensuring that you receive your proper compensation.
